(Washington, D.C.) — The Supreme Court has agreed to review a lawsuit by Virginia Uranium’s that challenges Virginia’s 35-year ban on uranium mining.

In a one-line order issued Monday, the justices granted a petition that the company sought in response to an appellate court ruling that dismissed the company’s lawsuit.

VUI to mine a huge deposit of the ore at the Coles Hill site near Chatham and filed a federal lawsuit last year. The action sought to nullify Virginia’s moratorium on Uranium mining, which has been in effect since 1982.

The review by the high court will only address the reasoning used by the Richmond-based Fourth U.S. Circuit Court of Appeals.
