DANVILLE, Va. – A prosecutorial mistake could result in the dismissal of the last of eight gang trials in Danville.

Marcus Davis is the final defendant set for trial for his alleged gang involvement. He faces a variety of felony charges, including attempted murder.

Danville Commonwealth’s Attorney Michael Newman presented tapes and notes from a December 2015 shooting that had not been made available previously to defense council.

His attorney immediately asked that the charges be dismissed. The judge made no immediate ruling but took the matter under advisement.

The trials of seven co-defendants ended in plea deals last week in Roanoke when similar problems were disclosed.
