SPOTSYLVANIA COUNTY,  Va. – A court appearance for a Spotsylvania County Sheriff’s deputy charged in the April shooting of an unarmed man has been postponed.

The Fredericksburg Free Lance-Star reports that 23-year-old David Matthew Turbyfill will now be arraigned on a felony charge of reckless handling of a firearm on Sept. 10.

The deputy is charged in the shooting of Isiah Brown, who Turbyfill thought was holding a gun. Turbyfill was responding to a disturbance report at Brown’s home when he shot Brown multiple times on April 21.

Turbyfill responded to Catharpin Road in Spotsylvania and came upon Brown, who was on his cell phone with 911 dispatch. Footage of the incident shows Turbyfill ordering Brown to put down his gun multiple times before opening fire. Investigators say Brown was not armed.

Brown survived but spent weeks in a local hospital before being discharged.
